Plain English Summary

SecondChat is an open, real-time chat layer for the web. We support broad freedom of expression while restricting spam, NSFW content, illegal activity, platform abuse, and conduct that creates real-world harm. We use automated systems, including AI moderation, to help detect and limit spam, sexually explicit content, scams, and abuse. This summary is not legally binding — read the full Terms below.

1. Acceptance of Terms

By installing, accessing, or using SecondChat (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. We may update these Terms from time to time. Continued use after updated Terms become effective constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years old to use SecondChat. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Description of the Service

SecondChat is a browser extension and communication layer that enables real-time chat rooms associated with web pages and online environments. Depending on the product surface, users may communicate through text messages, emotes, reactions, and similar interactive features.

4. User Accounts

4a. Guest access

You may use certain parts of the Service as a guest. Guest identities may be tied to your device or browser session and may have limited features.

4b. Registered accounts

You may sign in through supported third-party authentication providers, such as Google or Twitch. You are responsible for all activity that occurs under your account and for keeping your account secure.

4c. Usernames

We may reject, reclaim, or reassign usernames that impersonate others, infringe rights, are misleading, or are used abusively.

5. Acceptable Use

5a. Core principle

SecondChat is designed as open, real-time communication infrastructure for the web. We do not moderate content based on viewpoint, opinion, political position, or general offensiveness alone.

At the same time, the Service is not intended for adult content, spam, or platform abuse. We actively restrict NSFW content, automated abuse, scams, and other conduct that undermines a usable and broadly accessible environment.

By using the Service, you understand that conversations may be unfiltered in tone or viewpoint, but are still subject to the limitations described in these Terms.

5c. What is generally allowed

Unless content or conduct falls into the prohibited categories above, expression is generally allowed on SecondChat. This includes content that may be controversial, offensive, provocative, politically or culturally sensitive, or disagreeable. SecondChat does not act as the general arbiter of acceptable opinion or viewpoint.

6. Content

6a. User-generated content

You retain ownership of the content you post on SecondChat. By posting content, you grant SecondChat a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, and distribute that content solely as necessary to operate, improve, secure, and provide the Service.

6b. Responsibility for content

All content is the sole responsibility of the user who created it. SecondChat does not endorse user content, verify its accuracy, or take responsibility for what users say or share. By using the Service, you acknowledge that you may encounter content that is offensive, inaccurate, controversial, misleading, or disturbing.

6c. Moderation approach

SecondChat does not proactively curate conversations by viewpoint. We may monitor, review, restrict, remove, or limit content or access when necessary to comply with law, respond to abuse reports, prevent disruption or exploitation of the platform, enforce these Terms, or protect users and the Service from harm.

6d. Room-level moderation

Certain rooms, communities, environments, or integrations may implement their own moderation rules, filters, or restrictions. Those rules do not necessarily reflect the global policies of SecondChat.

6e. Ephemeral content

Chat messages are ephemeral by design. Messages may be automatically deleted after a limited retention period, typically around 30 days, unless a different retention period is stated for a particular feature or required by law.

6f. Automated moderation

SecondChat uses automated systems, including AI-based moderation, to detect and limit spam, NSFW content, scams, and abuse of the Service.

These systems are intended to protect platform integrity and enforce the restrictions described in these Terms, not to evaluate viewpoints or general opinions. Automated systems may result in content removal, reduced visibility, temporary holds, feature restrictions, or account enforcement.

We do not guarantee that automated systems will be error-free, uninterrupted, or perfect in every case.

7. Enforcement

We may take action in response to violations of these Terms or to protect the integrity, safety, legality, or operation of the Service. Actions may include removing or filtering content, issuing warnings, restricting features, suspending or permanently banning accounts, guest identities, devices, or access, and reporting unlawful activity to relevant authorities.

We generally focus enforcement on clear violations, abuse, spam, NSFW content, platform manipulation, legal risk, and conduct that threatens users or the Service. Attempts to evade enforcement measures are violations of these Terms.

8. Intellectual Property

The SecondChat name, logo, software, design, interfaces, and all associated materials are the property of SecondChat or its licensors and are protected by applicable intellectual property laws. Third-party emotes, content, or integrations displayed through SecondChat remain the property of their respective owners.

9. Advertising

SecondChat may display advertisements, sponsorships, promoted placements, or other commercial content to support the Service. Advertisements are not endorsements by SecondChat.

10. Tips and Payments

SecondChat may in the future offer optional features that allow users to send tips, make purchases, or engage in other payments. If offered, transactions may be processed by third-party payment providers and are subject to their terms. Unless otherwise required by law, payments and tips are final and non-refundable.

11. Third-Party Services

The Service may integrate with or rely on third-party services, including authentication providers (Google, Twitch), avatar generators, emote providers, and AI moderation services. Your use of those services is governed by their own terms and privacy policies. A complete list of external services the extension communicates with is available in our Privacy Policy.

12. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind. To the maximum extent permitted by law, we do not warrant that the Service will be uninterrupted, secure, error-free, or suitable for your needs, or that any user-generated content or moderation system will be accurate, lawful, or error-free.

13. Limitation of Liability

To the maximum extent permitted by law, SecondChat and its operators, owners, employees, contractors, licensors, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, business, data, goodwill, or other intangible losses arising out of or related to your use of the Service. Our total liability to you for any claim relating to the Service or these Terms will not exceed the greater of the amount you paid us in the twelve months before the claim or $100 USD.

14. Indemnification

You agree to indemnify, defend, and hold harmless SecondChat and its operators, owners, employees, contractors, affiliates, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Termination

You may stop using SecondChat at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we determine it is necessary or appropriate.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts.

17. Severability

If any provision of these Terms is found unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SecondChat regarding your use of the Service.
